Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Kryon platform and website operated by Kryon ("us", "we", or "our"). Your access to and use of the service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the service.

By accessing or using the service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the service.

1. Acceptance of Terms

By creating an account or accessing any portion of the Kryon platform, you affirm that you are at least 18 years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms.

If you are using the service on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms, in which case the terms "you" or "your" shall refer to such entity.

2. Description of Services

Kryon provides an AI-powered workflow automation platform that enables businesses to build, deploy, and manage automated workflows and AI agents. Features include workflow building, integration management, agent orchestration, analytics, and related tools (collectively, the "Services").

We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the Services (or any part thereof) at any time with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Services.

3. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password, whether your password is with our service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorisation, or a name that is otherwise offensive, vulgar, or obscene.

4. Acceptable Use

You agree not to use the Services for any purpose that is prohibited by these Terms. You may not use the Services:

• In any way that violates any applicable national or international law or regulation
• To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam)
• To transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware
• To access without authorisation, interfere with, damage, or disrupt any part of our service, any equipment or network on which our service is stored, any software used in the provision of our service, or any equipment or network or software owned or used by any third party
• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm Kryon or users of the Services or expose them to liability
• To reverse engineer, disassemble, decompile, decode, adapt, or otherwise attempt to derive or gain access to any software component of the Services

5. Intellectual Property

The Services and their original content, features, and functionality are and will remain the exclusive property of Kryon and its licensors. The Services are protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Kryon.

You retain all rights to any content you submit, post, or display on or through the Services ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, process, adapt, and display your User Content solely for the purposes of providing the Services to you.

6. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by this reference. Please review our Privacy Policy, which describes the types of information we gather from you and how we use your information.

7. Billing and Payment

If you elect to use paid features of the Services, you agree to the pricing and payment terms presented to you at the time of purchase, which we may update from time to time. Kryon may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in its sole discretion. Any change to our pricing or payment terms shall become effective in the billing cycle following notice of such change to you as provided in these Terms.

You authorise us to charge the applicable fees to the payment card or other payment method you submit. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.

8. Limitation of Liability

In no event shall Kryon, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorised access, use, or alteration of your transmissions or content

Whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

In all cases, our aggregate liability to you for any and all claims arising out of or in relation to these Terms or the Services shall not exceed the amounts you paid to Kryon in the twelve (12) months immediately preceding the event giving rise to the claim.

9. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will cease immediately.

If you wish to terminate your account, you may simply discontinue using the Services or contact us at hello@kryonai.com to request account deletion. Upon account deletion, we will delete your data in accordance with our Privacy Policy.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Services, and supersede and replace any prior agreements we might have between us regarding the Services.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Services.
